PRACTICE AREAS

Consumer Law

Consumer law involves all of the regulations and statutes that seek to create a more equitable balance for buyers in the marketplace and prevent sellers from using dishonest tactics. A consumer is any individual who purchases goods or services, which may be sold by manufacturers, wholesalers, or retailers.

Bankruptcy Adversary Proceedings

If you have filed bankruptcy, creditors are obligated to stop contacting you regarding the collection of any debt unless they request permission from the Court by official motion. But often, creditors skip this mandatory legal obligation and instead, ignore the Bankruptcy Stay and continue to contact the consumer. This is a violation of the Bankruptcy Code. According to the Bankruptcy Code, debtors are able to bring an adversary proceeding and should they prevail, depending upon the facts of the case, they may be awarded actual damages, punitive damages, as well as attorney’s fees and costs.

Please contact us if you have filed bankruptcy and continue to be contacted by creditors.

Mark worked very hard to get us money owed to us due to collectors trying to collect a debt that was discharged in bankruptcy. It took a while but that was due to the bank’s attorney not Mark at all. Mark did a fantastic job. A++
Thanks again Mark!

Mark came in during the middle of a situation I was already going back and forth to court for alone. On top of being super professional and extremely nice and easy to talk to, he handled the situation and was communicating the entire time. Very great service! 10/10”
